Terms of Service

1. Acceptance of Terms

By accessing and using Auctionly ("the Platform"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform.

2. Platform Fees

Auctionly charges a 7.5% platform fee on the winning bid amount of each successful auction. This fee is automatically deducted from the seller's payout. The platform fee does NOT include shipping costs - shipping is charged separately to the buyer and passed through to the seller.

3. Shipping and Delivery

• Sellers must specify accurate shipping costs for all auctions requiring shipping
• Shipping costs are displayed separately and added to the winning bid amount
• Buyers are responsible for paying both the winning bid AND shipping costs
• Total payment = Winning Bid + Shipping Cost
• Sellers must ship items within 1-2 business days of receiving payment
• Sellers are responsible for providing tracking information

4. Bidding Rules

• All bids are binding and cannot be retracted once placed
• You must have a valid payment method on file before bidding
• If you win an auction, your payment method will be automatically charged
• Failure to complete payment may result in account suspension
• Bid increments are set by the seller and must be respected

5. Seller Responsibilities

• Sellers must have an active Stripe Connect account
• Item descriptions must be accurate and truthful
• Photos must accurately represent the item being sold
• Shipping costs must be accurately calculated and disclosed
• Items must be shipped promptly after payment is received
• Sellers are responsible for handling returns within the 7-day window

6. Payment Processing

All payments are processed securely through Stripe. When an auction ends:

• The winner's payment method is automatically charged the winning bid + shipping
• The platform fee (7.5%) is deducted from the winning bid amount
• Shipping costs are passed through to the seller in full (no platform fee on shipping)
• Sellers receive their payout (winning bid - 7.5% platform fee + full shipping cost)
• Payouts are processed according to Stripe's standard payout schedule

7. Returns and Disputes

• Buyers have 7 days from delivery to request a return
• Items must be returned in original condition
• Buyer pays return shipping unless item is not as described
• Disputes must be resolved between buyer and seller first
• Platform may intervene in cases of fraud or Terms violations

8. Prohibited Items

The following items are strictly prohibited on Auctionly:

• Illegal goods or services
• Stolen property
• Counterfeit items
• Weapons and explosives
• Drugs and drug paraphernalia
• Adult content or services

9. Account Termination

Auctionly reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or fail to complete transactions. Repeated violations may result in permanent ban from the Platform.

10. Limitation of Liability

Auctionly acts as a marketplace platform connecting buyers and sellers. We are not responsible for the quality, safety, or legality of items listed, the accuracy of listings, the ability of sellers to complete sales, or the ability of buyers to complete purchases. All transactions are between buyers and sellers directly.

11. Changes to Terms

Auctionly reserves the right to modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.
